JAMMU: The BJP Human Rights Cell, Jammu & Kashmir, has expressed serious concern over the recent resolution passed by the NC & Congress seeking restoration of full statehood, particularly its reference to earlier Assembly resolutions concerning the constitutional position of Jammu & Kashmir.

In a joint statement, Shri Rajesh Thappa, Convenor, and Shri Sarfraz Hamid Rather, Co-Convenor, BJP Human Rights Cell, J&K, said that the NC & Congress must respect the Constitution of India and the binding judgment of the Hon’ble Supreme Court.

They said that the Supreme Court, in its judgment dated 11 December 2023 in In Re: Article 370, upheld the constitutional position concerning Article 370. The judgment, being a judgment of the Supreme Court, is binding under Article 141 of the Constitution of India.

“The NC & Congress has no constitutional authority to reverse, nullify or override a constitutional position settled by the Supreme Court and Parliament,”Shri Rajesh Thappa and Shri Sarfraz Hamid Rather said.

They further stated that restoration of statehood is a separate issue and should not be linked with any attempt to revive the constitutional arrangement that existed prior to August 2019.

“The Constitution is supreme, and the judgments of the Supreme Court are binding on all authorities. No resolution adopted by NC & Congress in Legislative Assembly can override the Constitution or nullify a judgment of the highest constitutional court of the country,” the leaders said.

The BJP Human Rights Cell urged all political parties to respect the constitutional position and concentrate on development, good governance, democratic institutions and the welfare of the people of Jammu & Kashmir.
